In response to rising numbers of violent crimes against gay military service members, President Clinton this week issued an executive order strengthening the military criminal code’s penalties for crimes “motivated by hatred based on the victim’s race, religion, ethnicity or sexual orientation.” The amendment also includes a privilege of confidentiality between service members and their psychotherapists. Unfortunately this confidentiality applies only in criminal cases, and not in administrative actions, which are the typical mechanism for discharging service members for their homosexuality.
