A week ago Judge Pamela Gilbert O’Sullivan took a twelve year old girl, twenty-nine weeks pregnant with her seventeen year old brother’s child, into the custody of the state after prosecuting attorney Carl Malinga filed a custody petition. Malinga was seeking to block the parents of the girl from taking her out of state. Late term abortions are illegal in Michigan unless the mother’s life is in danger.
Last Friday Malinga withdrew the custody petition, saying he had met with the family’s attorneys and felt that the girl had been counseled and that the parents had been informed. O’Sullivan then released the girl to her parents, who plan to take her to Kansas for the abortion. Malinga said that criminal charges would be filed against the brother.
